This book, Justiciability and Constitutionalism: an Economic Analysis of Law comes at a time when in several jurisdiction globally and within the African Continent, the question of justiciability of social economic rights have moved from mere rhetorics to taking positive and concrete steps in the realisation of the rights. India has been a trail blazer in this area. It has now become an imperative that States should move away from the hitherto dichotomous treatment of rights into civil and political rights contained in Chapter IV which are enforceable and economic and socio-cultural rights contained in Chapter II which are still regarded as non-justiciable in many jurisdictions including Nigeria.
